What Is Probate?

Under certain circumstance, when an individual passes away, his or her estate-bank account, houses, and other assets are subject to a court process called “probate.” In a probate proceeding, the state determines who is entitled to inherit property when a person dies. California probate law and procedures can be confusing for people who are not familiar with the process. There are a number of legal, financial, and tax-related issues that can create delays and unnecessary complications.

What Can I Expect In A Probate Administration?

Probate is the process by which the court determines where property shall pass either pursuant to the terms of a will, or if the person dies without a will, pursuant to the laws of intestacy.
